These terms apply when you buy website hosting, email hosting, domain registration, or related services from On The Edge, Inc. ("On The Edge", "we", "us"). By using our services you agree to them.
1. What we provide
We provide the services you and we agree to in writing, which may include:
- Website hosting and care — space on our managed servers, security updates, uptime monitoring, daily off-site backups, and support.
- Email hosting — mailboxes at your own domain name, with spam filtering.
- Domain registration — registering and renewing domain names on your behalf, including privacy protection.
- Website migration — moving an existing website, its database, email, and DNS onto our servers. Setting up an empty hosting account is free; if you would like us to perform the migration for you, it is a one-time service starting at $100.00 USD, quoted according to the size and complexity of the site. You are always free to perform the migration yourself at no charge.
- Website builds and custom work — quoted separately in writing before work begins.
Before anything is billed, we send you a written quote listing the exact services and the exact price. Services begin only after you accept it.
2. Prices and billing
All prices are in United States dollars (USD). Current standard pricing is published on our services page.
- Recurring services are billed in advance — monthly plans on the same day each month, annual plans on the same date each year.
- You receive an emailed invoice for every charge, sent through Stripe, with a link to pay securely online.
- One-time work (website builds, migrations outside a plan) is invoiced as agreed in the written quote.
- Domain registrations and renewals are charged yearly, because that is how the registrar charges us.
We do not raise the price of an existing service without telling you first. If we ever change your rate, we will give you at least 30 days' notice by email, and you may cancel before it takes effect.
3. Payment, late payment, and suspension
Invoices are due on the date shown on the invoice. If an invoice goes unpaid:
- We email you a friendly reminder with a payment link.
- If it remains unpaid, we contact you again and, where appropriate, grant a grace period — normally at least 14 days — during which your website stays online.
- Only after that grace period, and after we have tried to reach you, may we suspend the service. A suspended website shows a neutral "temporarily unavailable" page; your files, database, and email are not deleted at this stage.
- If an account remains unpaid for 60 days after suspension, we may terminate the service and delete the associated data. We will always warn you by email before deleting anything.
Reconnection fee. If your service is suspended for non-payment and you later ask us to restore it, a one-time reconnection fee of $50.00 USD applies, in addition to any outstanding balance. This covers the work of restoring your site, mail routing, and certificates. We charge it only after a suspension has actually taken effect — never as a late fee — and we routinely waive it where there were circumstances outside your control.
We would far rather talk with you than switch anything off. If money is tight, tell us — we routinely make arrangements.
4. Cancellation and refunds
You may cancel at any time. Our full refund and cancellation policy forms part of these terms.
5. Your content and your ownership
Everything you upload — your website, its text, images, databases, and your email — remains yours. We claim no ownership of it. We access it only as needed to provide support, perform backups, keep the service secure, or comply with the law.
If you leave, we will provide a copy of your website files, database, and email on request, at no charge, for up to 60 days after your service ends.
6. Acceptable use
You agree not to use our services to host or transmit:
- Anything illegal under United States federal or state law;
- Malware, phishing pages, or content designed to deceive or defraud;
- Unsolicited bulk email (spam), or mailing lists gathered without consent;
- Content that infringes someone else's copyright or trademark;
- Material that sexually exploits children, or that incites violence against any person or group.
We may suspend a service immediately, without the notice period in section 3, if it is actively causing harm — for example a compromised site sending spam or attacking others. We will tell you what happened and help you fix it.
7. Your responsibilities
- Keep your contact and billing details current, so invoices and warnings reach you.
- Keep your own passwords secure, and tell us promptly if you suspect a breach.
- Hold the necessary rights to the content you publish.
- Where you manage your own site software (for example WordPress plugins), keep it updated, or ask us to manage it for you.
8. Uptime, backups, and support
We monitor hosted websites continuously and aim for 99.9% availability, excluding scheduled maintenance, which we schedule outside business hours whenever possible and announce in advance where practical.
We take daily off-site backups and retain them for at least 30 days. Backups are a safety net, not a substitute for your own copies; we encourage you to keep your own as well.
Support is provided by email during United States business hours. We aim to respond within one business day, and far faster when a site is down.
9. Domain names
When we register a domain for you, it is registered in your name as the owner. You may transfer it away at any time, subject to the registrar's normal rules and any ICANN transfer waiting periods. Domain fees are set by the registrar and are non-refundable once a registration or renewal has been submitted.
10. Third parties we rely on
Delivering these services involves trusted providers, including Stripe (payment processing), Vultr (servers), MXroute (email delivery), Cloudflare (DNS and security), and Name.com (domain registration). Their own terms and outages may affect the service, and we choose them carefully.
11. Limitation of liability
We work hard to keep your site safe and online, but we cannot promise the internet will never break. To the maximum extent permitted by law, On The Edge's total liability for any claim relating to the services is limited to the amount you paid us for that service in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost profits or lost data, except where the law does not allow such a limit.
Nothing in these terms limits liability for fraud, or for anything else that cannot lawfully be limited.
12. Ending the agreement
You may end your service at any time under the cancellation policy. We may end a service by giving you 30 days' notice, or immediately for a serious breach of section 6. If we end a service for our own convenience, we refund any period you have paid for but not received.
13. Changes to these terms
We may update these terms as our services change. If a change materially affects you, we will email you at least 30 days before it takes effect, and continuing to use the service after that date means you accept the change.
14. Governing law
These terms are governed by the laws of the State of Colorado and the United States, without regard to conflict-of-law rules. Any dispute arising from these terms or our services shall be brought in the state or federal courts located in Colorado, and both parties consent to the jurisdiction of those courts.
